华盛顿州对川普诉讼听证录像

昨天,华盛顿联邦区法官 ROBART 暂时中止川普禁令。暂时中止令不只是适用于华盛顿州,而是全美国范围适用(“on a nationwide basis”)。读者可以参见文末的法庭命令。

一个地区的联邦法官可以在全美范围内中止美国总统的行政命令,美国的三权分立制度得到了检验与考验。不能不令人赞叹美国 创始人系统设计的冗余容错与稳定性 (redundant fault tolerance and stability)。

有人可能会问,麻省的那位联邦法官援引排华法案拒绝中止禁令,这个华盛顿法官却宣布中止禁令,两者如何统一呢?从逻辑上,一个联邦法官拒绝中止与另一个联邦法官同意中止并不矛盾,因为拒绝中止并非强制执行,只要有一个法院批准中止即可中止。进一步诉讼才能解决相关争议。估计星期一法院开门,川普的律师会冲进旧金山第九巡回法院递交文件。最终应该会打上美国最高法院。对美国法律熟悉的人士 可能会问:TRO 命令能上诉吗?参见 473 U.S. 1301,但是参见:467 F. 3d 999。

100多年前,1861年5月, 美军逮捕一名马里兰州的立法委员,后者的律师紧急向联邦法院提请 habeas corpus。联邦法院命令林肯手下战将 George Cadwalader  交出该立委。 Cadwalader  向法院递交了一封信件,说根据林肯的命令他不能交人。秀才不怕兵,法官大怒,判处 Cadwalader 将军 藐视法院林肯律师 出身,悍然宣布中止 habeas corpus,理由是宪法规定国会可以暂时中止 habeas corpus,但当时国会休会,只好由他总统来了。美国最高法院首席法官 “著名的” Roger Taney 判决林肯无权中止,Ex parte Merryman, 林肯不予理睬。枪杆子里出政权,信乎!但毕竟那是内战时期,数十万联邦政府军处于作战状态。两个月之后,联邦军与南部军进行了第一次大规模战斗 -- First Battle of Bull Run,双方投入兵力数万人。无论是否美国人,不知美国内战就不懂美国,如同中国人不知汉史就不懂中国一样,是我读了美国内战史后的深刻感受。对相关历史不清楚而又对美国感兴趣的,可以查阅相关资料。

对川普案有兴趣的可以看看下面的听证录像。法庭上双方心平气和的讲道理,这是文明社会文明人的表现。法制国家的管理者必须懂法(或者幕僚必须懂法),否则将会到处碰壁。

川普作为强大美军的最高统帅,一句话足以让地球上大部分国家战战兢兢。川普禁令以来,美国群众游戏抗议,无济于事。但几个手无缚鸡之力的专业人士跑到联邦法院引经据典地说一通话,这道禁令就被(暂时)废止。这说明什么呢?知识就是力量啊。当年排华法案 的制订,美国国会也进行了相当长时间辩论,但那时华人基本属于文盲苦力、麻木不仁,更不会去说话进行逻辑反对。等到排华法成为法律,也就只能继续听天由命了。
